The brief
BIICL is seeking a Research Consultant to undertake assignments as part of the BIICL and Ministry of Justice (“MOJ”) Project - Enhancing Judicial Capacity and Capability in Ukraine - designed to enhance judicial delivery and dispute resolution delivery in commercial disputes in Ukrainian courts, and in so doing to contribute to the economic and commercial recovery of Ukraine. 
 
We are looking for a practitioner or an academic experienced in commercial law litigation and/or arbitration, drafting judicial decisions concerning commercial disputes and designing workshops for judges 
 
The main task will be to draft training materials for a workshop for Ukrainian judges from the commercial jurisdiction that will include an overview of best international practice, case law and practical assignments. Other tasks will include researching Ukraine's current justice reforms, current ways in which Ukraine's justice system deals with commercial disputes and capacity gaps within the Ukraine judiciary, and drafting commentary on these, drafting technical guidelines on delivering the training and will involve participation in meetings with the Ministry of Justice, Judicial Office, International Advisory Board consisting of UK and Ukrainian judges, and preparing notes following the meetings.
 
Background
The British Institute of International and Comparative Law (BIICL) is a leading independent research institute based in London.
 
The successful candidate will contribute to a project on Commercial Dispute Resolution in Ukraine – Enhancing Judicial Capacity and Capability.  
 
The Research Consultant will undertake the following duties, working in conjunction with the Project Director (Maria Tymofienko) and others engaged on the project: 
 
·       Conduct research to identify capability gaps in the judiciary overseeing Ukraine’s commercial jurisdiction.
·       Conduct research to ascertain what other technical assistance and training projects on judicial capacity building in the Ukraine are being or will be delivered or planned, to avoid duplication.
·       Contribute to drafting of stakeholder questionnaires.
·       Attend and record meetings with stakeholders.
·       Contribute to discussions with other team members and designated trainers on the structure and format of training to be delivered.
·       Contribute to discussions with other team members, designated trainers and other stakeholders on the selection process for participants in the training.
·       Draft training materials in coordination with the project team members, designated trainers and stakeholders
·       Take notes and produce action summary following meetings with International Advisory Board, MOJ and other relevant stakeholders
 
Person Specification
 
Experience
·       Practical experience of dealing with commercial cases and/or arbitration cases ideally involving Ukrainian parties and /or heard in Ukrainian courts
·       Knowledge of Ukrainian justice reforms and the operation of the Ukrainian judicial system
·       Knowledge of Ukrainian and international commercial law and practice 
·       excellent legal drafting skills in English and Ukrainian 
 
Knowledge 
·       An understanding of court processes in England and Ukraine. 
·       It would also be useful to have experience of court processes in Ukraine or a civil jurisdiction. Also familiarity with the law of arbitration,  recognition and enforcement of arbitral awards, mediation, insolvency, and corporate law.
